Terms of Service

1. Acceptance of Terms
By accessing or using PrepTalk ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service. These terms apply to all users of the Service, including employers, recruiters, and interview candidates.
2. Description of Service
PrepTalk provides an AI-powered interview and learning platform that enables organizations to conduct automated behavioral interviews and deliver structured learning programs. The Service includes:
- AI avatar-driven interview sessions
- Real-time speech-to-text transcription
- AI-powered scoring and analytics
- Interview reports and insights
- Template management system
- AI-driven student learning modules with multilingual content
- AI coaching sessions and assessments
- Organization dashboard and student management
2A. Organization Accounts
Organizations ("Org Admins") who subscribe to the learning platform agree to:
- Maintain accurate organization profile information (name, contact, address)
- Take responsibility for student accounts created under their organization
- Not exceed allocated usage caps (tests, coaching sessions) per their plan
- Comply with data isolation policies — student data is scoped to each organization
- Accept that accounts may be suspended for non-payment or policy violations
2B. Student Learning Platform
Students enrolled through an organization agree to:
- Follow the sequential learning path (Learn → Coach → Test)
- Provide a preferred language selection; AI-generated content may be localized accordingly
- Accept that quiz and assessment scores are tracked and visible to the organization admin
- Not share credentials or attempt to access other organizations' data
- Understand that streak data and progress metrics are retained for gamification purposes
3. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscription and Payments
The Service is provided on a subscription basis. By subscribing, you agree to pay all fees associated with your chosen plan. Payments are processed through Razorpay and support UPI, credit cards, debit cards, and net banking.
All fees are non-refundable except as described in Section 4A (Refund Policy) below.
4A. Refund Policy & Usage Limits
7-Day Money-Back Guarantee (Subscriptions Only): New subscription customers are eligible for a full refund within 7 days of their first purchase, subject to the following conditions:
- Pay-As-You-Go (PAYG) purchases are strictly non-refundable and are not covered by the 7-day guarantee.
- For subscriptions, refund is available only if total credits consumed are 1.0 or fewer (equivalent to 2 interviews).
- If you have consumed more than 1.0 credits on a subscription, the purchase is non-refundable.
- Refund must be requested within 7 calendar days of the first subscription payment.
- Each customer is eligible for one refund only.

Usage Limits & Fair Use: All plans include daily usage limits to ensure fair access for all users and prevent system abuse:
- AI-powered features (essay evaluation, speaking evaluation, text-to-speech, AI text enhancement) are subject to daily caps based on your subscription plan
- Pay-As-You-Go users can unlock learning modules progressively as they purchase credits; access is paused (not lost) when credits are depleted
- Organization plans include monthly caps on tests and coaching sessions per student, as specified in your plan
- Public demo features are rate-limited per IP address to prevent automated abuse
- Exceeding usage limits will result in temporary restrictions until the next reset period (daily or monthly, depending on the limit)
Credits & Interviews: 0.5 credits = 1 interview session (30 minutes). Each interview includes AI-powered evaluation, scoring, and report generation at no additional cost. Learning module evaluations (essays, speaking practice) are included in all plans and controlled by daily limits rather than credit deductions.
5. Data Protection & Privacy
We process personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP) and our Privacy Policy. By using the Service, you consent to the collection and processing of data as described in our Privacy Policy.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Share your account credentials with third parties
- Use the Service to discriminate against candidates
7. Intellectual Property
The Service and its original content, features, and functionality are owned by PrepTalk and are protected by international copyright, trademark, and other intellectual property laws.
8. Limitation of Liability
To the maximum extent permitted by law, PrepTalk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
9. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new Terms of Service on this page and updating the "Last updated" date.
